TERMS AND CONDITIONS

  1. Terms and conditions of sale and goods taken

All goods are sold with all risk transferring to the customer upon payment voetstoets. 

 

  1. Nature of the goods : Secondhand & handmade from natural materials

All goods are sold by the seller and accepted by the buyer on the basis of them being used, of second-hand value and with flaws, due either to their handmade nature or due to wear over time.

All goods can change due to stretching, shrinking, staining, fading, colour-running, fraying, insect damage and any other loss or damage not mentioned herein. 

 

  1. Refund Policy – NO REFUNDS are offered, for any reason. No refunds are offered regardless of whether the carpet was ordered and delivered online or viewed and collected in person.

 

  1. Exchange Policy – No refunds, only exchanges from existing stock.

Should a buyer be unsatisfied with their purchase, the buyer may exchange the carpet for a carpet of similar value that is selected from the currently existing stock, provided that the carpet is unused and in exactly the same condition as upon purchase. 

To be eligible for an exchange:

  • The buyer must notify us within 48 hours of purchase that the buyer will be exchanging the carpet
  • The carpet must be returned and received by the seller within 7 calendar days of purchase
  • The carpet must be unused
  • The carpet must be returned in exactly the same condition as when it was purchased. Carpets that have become damp, have pet staining or odour, become torn or sustained any other damage will not be accepted for exchange. 
  • The condition reported in the invoice will be used as the evidence of the agreed condition upon purchase by the buyer.

If the carpet has been couriered:

  • the return & replacement courier is for the buyers account
  • the buyer is responsible for packing and couriering the carpet safely
  • The buyer is responsible for arranging insurance during transit and accepts all risk against hazard or loss in the goods. The airways, railways or any other cartage contractor or post office, in accepting and delivering the said goods for the buyer, shall always be deemed to be agents of the buyer.
  • Proof of return of any goods shall be acknowledged by way of written acceptance thereof by the seller and no other method
  • The exchange will only be processed if the carpet is received in exactly the same condition as upon original despatch.
  • The return courier charge of the replacement carpet will be for the buyer’s account.

 

  1. The buyer’s responsibilities prior to payment

Since the goods are secondhand, all buyers should take all of the following actions prior to purchase :

  • The buyer should view all pictures and/or videos;
  • The buyer acknowledges that pictures and videos captured and transmitted via digital devices do not record and display colours with fidelity nor do they render texture well nor adequately suggest scale, so viewing in person is strongly encouraged. Buying secondhand items online using digital transmission as a basis for purchase is undertaken at the buyer’s risk and with their knowledge of the shortcoming of digital transmissions in rendering colour, texture and scale 
  • The buyer should read all descriptions
  • The buyer should request further information if uncertain
  • The buyer should ensure that the size is suitable for the space
  • The buyer should ensure that they’ve read and understand all aspects of the condition report including what the words ‘vintage’, ‘pre-loved’ and ‘as-new’ signify.
  • The buyer should view the carpets in person or ask a trusted person to view on their behalf if they are not in Gauteng; should the buyer decide not to view in person, the buyer accepts the risk of buying as ‘voetstoets’.

 

  1. Courier
  • Courier is offered at the seller’s discretion and is decided on a case-by-case basis.
  • Buyer’s must be aware that carpets are sold on a NO RETURN basis. Exchanges are considered provided that all conditions regarding exchanges in clause 4 are met.  Buyers should consider the expense and time that an exchange would involve. 
  • If the buyer has any hesitation regarding a carpet, its colour, its condition, the seller or their knowledge of carpets, then the seller should not purchase the secondhand carpet online and via courier and should rather make an arrangement to view in person when in Johannesburg.
  • If offered, courier is for the buyer’s account.
  • All risk transfers to the buyer upon purchase including the risks during transport.
  • Carpets are bound with rope and wrapped in 100micron plastic to prevent water from penetrating.
  • Carpets are couriered via economy service which allows for delivery within 1 to 3 working days of despatch from the seller.
  • Buyers must ensure that they are available to receive the parcel at the address they provide if they order via courier. Carpets that are not delivered because the buyer was not available for receipt remain the buyers risk.

 

  1. The buyer’s risk upon payment

Upon payment, the risk for the purchase transfers to the buyer immediately. 

The payment will be understood as evidence that :

  • the buyer has personally and physically inspected/ examined the goods concerned prior to taking delivery thereof and is satisfied with the condition;
  • the buyer has inspected and noted all defects, imperfection, mark or stain on the goods and agrees that same are in “good order” or satisfactory for purchase;
  • that if the buyer was not personally inspected the items, they accept full risk as voetstoets;
  • the buyer has undertaken all of the above actions per clause 3 and that the buyer understands that all goods are bought by the buyer voetstoets or as-is.

With the payment of the buyer, the buyer acknowledges receipt of the said goods in agreed order and repair and has agreed to abide by all the terms and conditions hereof.
